Add-on course terms.
1. About these terms
These terms apply when you buy a place on one of our add-on courses, a pack of places or the private option (section 3). Together with the description of the course (section 3), they are the contract between you and us. You accept them at checkout, before you pay. You can save or print this page.
“We” and “us” means Do Your Bit Limited. “You” means the business that buys the place and, where these terms deal with taking part, the person who takes the place. “The fee” means the total you paid for your place, your pack of places or the private option, including any VAT. “The Scale at Speed course” means the course that our course terms (scaleatspeed.com/legal/course-terms) cover. “A working day” means Monday to Friday, except public holidays in England.
We sell the add-on courses only to businesses, for use in their business. At checkout you confirm that you are buying for the purposes of your trade, business or profession, and not as a consumer. If you are in fact a consumer, the law gives you rights that no contract can take away, and nothing in these terms affects them.
These terms cover the add-on courses only. They do not change the course terms, which still apply to any place you hold on the Scale at Speed course.
2. Who we are
Scale at Speed is run by Do Your Bit Limited, a private limited company registered in England and Wales under company number 08130003.
- Registered office: Suite 2a, 7th Floor - Pf City Reach, 5 Greenwich View Place, London, England, E14 9NN
- VAT number: GB 234 5413 28
- Email: [email protected], the quickest way to reach us about anything to do with an add-on course
We sell the add-on courses on our course platform, at www.scaleatspeed.academy.
3. What you are buying
Each add-on course is a live course, taught online to a group, on a set date and at a set time. A place is for one person, on one date of one add-on course. Where the add-on page or a checkout says “seat”, it means a place. The add-on page for each course (the page on www.scaleatspeed.academy that sells it) gives its dates and times.
The add-on courses on sale under this version of these terms are:
- How to win more with value-based selling: one live session of 150 minutes, with a 10-minute break, on the dates and at the times the description of the course gives. It asks for about 20 minutes of pre-work on a deal of your own (section 4). A date runs with six people or more (section 10).
Packs of places. Where the add-on page offers one, a pack of three places is three places on the same date of the same course, for people who work in the business that buys it. Email us the name and email address of each person who will take a place, as section 4 says under “Buying for someone else”. Each place in a pack can be moved on its own (section 7), and a pack is refunded as a whole (section 8).
The private option. Where the add-on page offers it, you can buy a private session of a course for your business alone. Section 11 sets out how it works.
We design and teach some add-on courses, or some dates of them, ourselves. For others, an outside company designs the course or provides the trainer who teaches it, under a written contract with us. The description of the course says who teaches your date. We sell every add-on course in our own name. Your contract is with us, not with any company that provides a course or a trainer, and we are responsible to you for the whole course, including any part that such a company provides.
An add-on course is separate from the Scale at Speed course. Buying a place does not give you access to the Scale at Speed course, and a place on the Scale at Speed course does not include the add-on courses.
“The description of the course” means what these pages said about your add-on course and your date when you paid: the add-on page for your course and the checkout page you paid on. What the description promises about the course is part of this contract, including anything this section does not mention. What it says about the price that other people will pay in future is not a promise to you. If the description and these terms say different things about the same point, these terms apply. We keep a dated copy of each of these pages every time it changes.
If the date you paid for is already full when your payment goes through, or has fewer free places than you paid for, we will offer you the places you paid for on another date of the same course or a refund of the whole fee, whichever you choose.
4. How you buy
Each date of each add-on course has its own checkouts, in pounds sterling and in US dollars: one for a single place and, where the add-on page offers one, one for a pack of places. Choose the course and the date on the add-on page, and open that date’s checkout. The private option has one checkout in each currency, and we agree its date with you after you buy (section 11). Enter your details; you can check and correct them until you press the pay button. Before you pay, the checkout asks you to tick a box to confirm that you are buying for your business, not as a consumer, and that you accept these terms.
Each date has a limited number of places. Bookings for a date close at 23:59 UK time two working days before it, or earlier if the date is full.
The contract is made when your payment goes through. We then email you a confirmation of your purchase, with a link to these terms. We keep a record of your order and of the version of these terms that applied, and we will send you both if you ask. The contract is in English. We do not subscribe to any code of conduct.
Buying for someone else. If someone else in your business will take the place, or a place in a pack of places you bought, email us their name and email address by 23:59 UK time two working days before the session. We send the joining link to them. If you tell us later, we send it as soon as we can, but we cannot promise it will reach them in time.
Joining details. We email the joining link, and anything you need to prepare, to the email address you gave at checkout, or to the person who takes the place, at least one working day before the session, unless you named that person later than these terms ask. If it has not arrived by then, check your spam folder and email us.
Pre-work. If the description of the course asks for pre-work, we send the brief for it when you buy, and to each person you name when you name them. You bring your pre-work to the session and do not send it to us. We use your deal in front of the group only if you agree, and we ask you before the session.
5. Price and payment
The price is the one shown on the checkout page when you pay, in pounds sterling or in US dollars. If your business is in the UK or the Isle of Man, buy at a checkout in pounds: our US dollar checkouts are for businesses elsewhere. Our prices do not include VAT or any other tax.
If your business is in the UK or the Isle of Man, we add VAT at the rate in force when you pay, now 20 per cent, and the checkout shows it before you pay. If your business is anywhere else, we do not add UK VAT, and you account for any tax due in your own country. If we have to charge any other tax, the checkout shows it before you pay. The total on the checkout page is the amount you pay, and there are no other charges.
Give us accurate details at checkout: your business’s name, a billing address that is the address of the business that is buying, and its VAT number or other tax ID if it has one. By buying, you confirm that you may buy for that business. If the person who will take the place is based in a different country from your business, tell us before you buy, because that can change the tax. We may ask for more information where we need it to charge the right tax.
You pay at the checkout, by card or by another method the checkout offers. Our course platform and its payment providers process the payment, and we never see your full card details.
We email you a receipt when you pay. If your business is in the UK or the Isle of Man, we also send you a VAT invoice within 30 days after the day you pay. We use the business name, address and VAT number you give at checkout; if the checkout did not ask for them, email them to us. If you need another kind of invoice, email us and we will send one.
You pay the whole fee in one payment at checkout. We do not offer instalments.
A later change to our prices does not affect a purchase you have already made.
6. The members’ discount
Members of the Scale at Speed course get 10 per cent off the price of a place, or of a pack of places, before VAT. Where VAT applies, we add it to the reduced price. The discount does not apply to the private option (section 11).
A member is a person who holds a paid place on the Scale at Speed course (Solo, the Cohort or the Inner Circle) on the day the add-on purchase is made, and whose access to it has not ended. A free, trial or test place does not count.
The discount is for places that a member’s business buys, for the member or for someone else who works in that business.
To get it, enter the members’ code at checkout. We give the code to members. The code may be used only for places that a member’s business buys. We cannot add the discount after you have paid, and it cannot be combined with any other discount code. The price of a pack of places already includes a reduction for buying three, and the code applies to that price.
Our checkout cannot check that a place is for a member’s business. If you use the code and are not entitled to the discount, we may ask you to pay the difference within 14 days after we ask. If you do not, we may cancel the place and refund what you paid; if the session has already taken place, you owe us the difference.
If we later refund the fee for your place on the Scale at Speed course, you keep the discount you have already had.
7. Changing your booking
Moving to another date. If you tell us at least 7 days before your date that you cannot take part, we will move your place to another date of the same course that has a free place, once, at no charge. You keep the price you paid, in the currency you paid in. Moving does not start the refund period again. Each place in a pack of places can be moved on its own.
Sending someone else. If you cannot take part, someone else who works in your business may take your place. Email us their name and email address by 23:59 UK time two working days before the session, and we will send the joining link to them. If you tell us later, we send it as soon as we can, but we cannot promise it will reach them in time.
One person for each place. Each place is for one person. The joining link is for the person who holds the place: do not share it. A colleague who also wants to take part needs their own place.
8. Refunds
If you ask by email within 14 days after the day you paid, and at least 7 days before your date, we refund the whole fee. You do not have to give a reason. After that, we do not refund any part of the fee, including if you miss the session or cannot take part, except as section 3 says for a date that is already full, section 6 for a place we cancel, section 10 for a session that does not run as planned, and section 11 for the private option. If you book less than 7 days before your date, the refund period has already ended when you book.
Packs of places. The rule above applies to a pack of places as a whole: we refund all its places together, not some of them. If someone in your business cannot take part, someone else who works in it may take their place (section 7).
How refunds work. Ask by email to [email protected]. We refund to the payment method you used, in the currency you paid in, within 14 days after the day you ask, and we charge no fee for it. Any currency conversion by your bank or card provider is outside our control.
9. If you miss the session
If you do not join the session, or you join late or leave early, we do not refund any part of the fee, and we do not run the session again for you. We do not record the sessions, so there is no recording to watch.
To take part you need a computer, tablet or phone with a camera, a microphone and an internet connection good enough for a video call, and the app or browser that the joining link asks for. If a problem on your side stops you joining, that counts as missing the session.
10. If a session does not run as planned
If we move a session. If we have to move a session to another day or time, we tell you as early as we can. You choose: the new day or time, a place on another date of the same course that has a free place, or a refund of the whole fee.
If the trainer cannot teach. If the trainer that the description of the course names for your date cannot teach, we may ask another trainer to teach the session: one of ours, or one from a company that provides the course for us. We tell you who as early as we can. If you would rather not take part with that trainer, tell us before the session starts, and you choose: a place on another date of the same course that has a free place, or a refund of the whole fee. If no trainer can teach, the session is cancelled.
If a session is cancelled. If a session is cancelled, for example because no trainer can teach or because a company that provides the course for us cancels the date, we tell you as early as we can. You choose: a place on another date of the same course that has a free place, or a refund of the whole fee. If no other date of the course is open for booking, we refund the whole fee.
Too few bookings. A date runs with the number of people that section 3 gives for its course, or more. If fewer have booked by 23:59 UK time 7 days before the date, we may cancel it. If we do, we close its bookings and tell you by the end of the next working day, and you choose: a place on another date of the same course that has a free place, or a refund of the whole fee. We do not cancel a date for too few bookings after that.
If a session is cut short. If a problem on our side or the trainer’s means that more than 30 minutes of a session is lost, you choose: a place on another date of the same course that has a free place, or a refund of the whole fee.
11. The private option
This section applies when you buy the private option: a private session of an add-on course for your business alone. Where it says something different from sections 3 to 10, this section applies.
Who takes part. Up to eight people may take part, and all of them must work in your business. Each of them takes a place in the private session. Email us the name and email address of each of them by 23:59 UK time five working days before the agreed date; section 4 says what happens if you name someone later. The description of the course says what the private option includes.
Agreeing the date. We agree the date and time with you by email within 90 days after the day you pay, and in that time we offer you at least three dates that fall within those 90 days. The date may be later if we both agree. If we have not agreed a date within the 90 days, either of us may cancel the private option by email, and we refund the whole fee.
Moving the agreed date. If you tell us at least 7 days before the agreed date, we will move it once, at no charge, to another date that we agree with you. Moving does not start the refund period again.
Refunds. If you ask by email within 14 days after the day you paid, and, once a date is agreed, at least 7 days before it, we refund the whole fee. After that, section 8 applies, with the agreed date as your date.
What does not apply. The members’ discount (section 6) and the rule on too few bookings (section 10) do not apply to the private option. Where section 10 offers a place on another date of the same course, you may instead agree a new date for your private session with us. If fewer people join than you named, we do not refund any part of the fee.
12. Using the course material
Each add-on course and everything in it, including what the trainer presents and any slides, handouts, worksheets, workbooks and templates, belongs to us, to any company that provides the course for us, or to the people who have allowed us or that company to use it. Buying a place, a pack of places or the private option gives your business permission to use the handouts, worksheets, workbooks and templates you are given, in your business, and to apply what the course teaches. It gives no other rights and does not transfer ownership.
You must not record the session. You must not copy, share, publish or sell the course material, or use it to run training or consulting for anyone outside your business, unless we have agreed to that in writing. What you write in the worksheets, workbooks and templates is yours; the material around it is not.
13. Taking part
Everyone in a session must:
- keep confidential what other people say or show about their businesses, including the details of their deals, and not use it for any purpose of their own;
- treat everyone with respect;
- not record the session in any way, including screenshots and photographs;
- not name or identify their staff, clients or prospects: use roles or initials;
- not share health or other sensitive details about anyone.
If someone seriously or repeatedly breaks these rules, we, or the trainer for us, may remove them from the session. We will warn them first unless the breach is serious, and we will tell them why we acted. We do not refund any part of the fee when we remove someone for breaking these rules. Breaking these rules leads only to the steps in this section.
The person who takes a place. Whoever takes a place your business bought must know and follow sections 7, 12 and 13. You are responsible if they break section 7 or 12. A breach of section 13 leads only to the steps in this section.
14. Results
We cannot promise any particular result for your business, because results depend on your market, your team, how you apply what you learn and things outside anyone’s control. The add-on courses are education. They are not financial, legal, tax or investment advice; for those, speak to a qualified professional.
15. Our responsibility to you
What we never limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude.
Our limits. Subject to that, we are not liable for loss of profit, revenue, business, contracts, goodwill or anticipated savings, or for any indirect or consequential loss. Our total liability to you under or in connection with this contract, whether in contract, in tort (including negligence) or otherwise, is limited to the fee.
16. Personal data
We use the personal data of the person who buys the place, and of the person who takes it, to provide the add-on course, to take payment, to send receipts and the joining details, and to keep the records the law requires. Our course platform sells the places, and our payment processor processes payments through it. The session runs on our video-call service, and we do not record it or save its chat. Where a company provides the course or the trainer for a date, we do not give that company the name, the email address or any other details of anyone who books. Its trainer sees and hears the people who join the session, as anyone on the call does. We describe these providers by what they do rather than by name; if you want to know who one of them is, email us and we will tell you. Our privacy policy (scaleatspeed.com/legal/privacy#add-on-buyers) explains the rest: what we collect, why, how long we keep it and the rights of the people it is about.
17. Questions and complaints
If you have a question or a complaint, email [email protected] or write to us at our registered office (section 2). We aim to reply within two working days, and we will do our best to put things right. If we cannot resolve a complaint, we will give you our final answer in writing.
18. Changes to these terms
We may update these terms for future purchases. The version in force when you bought applies to your purchase. We will not change the terms of a purchase you have already made unless the law requires it, and if we have to, we will tell you. Each version is dated at the top of this page, and we will send you the version that applied to your purchase if you ask.
19. Other legal points
- Transfer. We may transfer this contract to another business, for example if the add-on courses are sold. We will tell you, and your rights under these terms will not be affected. You may transfer it to someone else only with our written agreement, apart from sending someone in your place under section 7.
- Only the business that buys the place and we have rights under this contract. Nobody else can enforce it, including the person who takes the place and any company that provides the course for us.
- If a court finds part of these terms unlawful, the rest stays in force.
- If we do not insist on something straight away, we can still insist on it later.
20. Law and courts
These terms are governed by the law of England and Wales, and only the courts of England and Wales can hear a dispute about them.
